Welcome to OpiScope. These Terms of Service ("Terms") govern your access to and use of the OpiScope platform, including all products, features, and services provided by ThePrimeContact ("we", "us", "our").
By creating an account, accessing, or using OpiScope, you agree to be bound by these Terms. If you do not agree, do not use OpiScope.
These Terms work together with:
- Platform Privacy Policy — how we handle your personal data
- Product Terms of Service — product-specific terms for each product you use
- Acceptable Use Policy — what you must NOT do on the platform
2. Definitions
These terms are used throughout these Terms and all OpiScope legal documents:

| Controller (or "Data Controller") | The legal entity that determines the purposes and means of processing personal data, as defined in Art. 2 of Organic Law 2004-63. In our product interface, this is called "Organization." In our marketing materials, this is called "Publisher." |

| Publisher | The marketing/commercial term for the Organization. |
| Org Owner | The natural person authorized to bind the Organization and accept legal documents on its behalf. |
| Team Member | An employee or agent of the Organization acting under its authority. |
| Survey Creator | A Team Member or the Org Owner with permission to create surveys on behalf of the Controller. |
| Processor | An entity that processes personal data on behalf of the Controller. OpiScope acts as Processor for product data. |
| Respondent | A natural person who participates in a survey by providing responses. |
| Personal Data | Any information relating to an identified or identifiable natural person (Art. 2, Organic Law 2004-63). |
| Sensitive Data | Data relating to health, religion, politics, race, union affiliation, genetic or biometric data (Arts. 47-49, Organic Law 2004-63). |
| Anonymized Data | Data that cannot identify any natural person by any means reasonably likely to be used. Anonymized data is NOT personal data and falls outside the scope of Organic Law 2004-63. |
| INPDP | Instance Nationale de Protection des Données Personnelles — Tunisia's national data protection authority. |
| Flag | A report submitted by any person alleging that a survey violates OpiScope's Terms, Privacy Policy, or applicable law. |
3. Eligibility
3.1 Who Can Use OpiScope
You may use OpiScope if:
- You are 16 years or older (or the age of majority in your jurisdiction)
- You have the legal capacity to enter into a binding contract
- You are not prohibited from using the platform under applicable law
- You have not been suspended from OpiScope previously
3.2 Organizations
If you use OpiScope on behalf of an organization, you represent and warrant that:
- You are authorized to bind the organization to these Terms
- The organization agrees to these Terms
- You will ensure all users within your organization comply
3.3 Minors
OpiScope is not directed at children under 16. Products that may involve children (e.g., educational surveys) require verifiable parental consent and are governed by the applicable Product Terms.
4. Account Registration & Security
4.1 Creating an Account
To use OpiScope, you must create an account by providing:
- Valid email address
- Your name (or organization name)
- A strong password
4.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your credentials
- All activities that occur under your account
- Notifying us immediately of unauthorized access
4.3 Account Types

5. Products & Services
5.1 Product Ecosystem
OpiScope is a multi-product platform. Current and planned products include:

5.2 Product-Specific Terms
Each product has its own Terms of Service. You must accept the Product Terms before activating each product. In case of conflict between these Platform Terms and Product Terms, the Product Terms govern for that specific product.
5.3 Product Availability
- Products may be added, modified, or discontinued at our discretion
- We will provide at least 30 days' notice for material changes to a product you are using
- If a product is discontinued, we will provide data export options
6. Subscriptions & Billing
6.1 Subscription Plans
Access to OpiScope products is offered through subscription plans:
- Free tier — limited features, no cost
- Paid plans — full feature access, billed monthly or annually
- Enterprise — custom pricing, dedicated support
6.2 Billing & Payment
- Subscriptions are billed in advance (monthly or annually)
- Payments are processed by our payment processor (Stripe)
- All prices are in [currency] and exclude applicable taxes
- We issue invoices for all payments (available in your account)
6.3 Subscription Renewal
- Subscriptions automatically renew unless canceled
- You may cancel at any time through your account settings
- Cancellation takes effect at the end of the current billing period
6.4 Price Changes
- We may change prices with at least 30 days' notice
- Price changes take effect at the next renewal after the notice period
- Continued use after a price change constitutes acceptance
6.5 Refunds
- Free tier: No refunds (no charge)
- Monthly plans: No refunds for partial months
- Annual plans: Prorated refund if canceled within 30 days of renewal

7. User Responsibilities
7.1 Acceptable Use
You agree to:
- Use OpiScope in compliance with all applicable laws
- Respect the rights of other users and third parties
- Maintain the security of your account
- Cooperate with us in investigations of violations
7.2 Prohibited Activities
You must NOT:
Illegal & Harmful:- Use OpiScope for any illegal purpose or in violation of applicable laws
- Harass, threaten, defame, or discriminate against others
- Distribute malware, viruses, or other harmful content
- Engage in fraud, phishing, or social engineering
- Attempt to gain unauthorized access to OpiScope systems
- Interfere with or disrupt the platform's operation
- Circumvent security measures or access controls
- Use automated means (bots, scrapers) without authorization
- Collect, store, or process data you have no right to process
- Infringe on intellectual property rights of others
- Remove or alter any proprietary notices
- Resell or sublicense OpiScope access without authorization
- Use OpiScopeSurvey to conduct non-research activities disguised as research
- Use OpiScopeSurvey to collect sensitive data without proper consent and INPDP authorization
- Misrepresent the purpose of your research
- Fabricate or manipulate survey data
7.3 Consequences of Violations
Violations may result in:
- Warning and request to cease the violation
- Temporary suspension of specific features
- Permanent suspension of your account
- Reporting to law enforcement (for illegal activity)
- Civil liability for damages
8. Data & Privacy
8.1 Platform Data
Your use of OpiScope is governed by our Platform Privacy Policy, which describes:
- What platform data we collect
- How we use it
- Your rights
- How to exercise them
8.2 Product Data
Each product has its own Privacy Notice. Read it before using the product.
8.3 Your Responsibilities as Data Controller
If you use OpiScope products to collect data from others (e.g., survey respondents), you are the data controller for that data. You are responsible for:
- Having a legal basis for collection
- Providing a privacy notice to your respondents
- Responding to data subject requests
- Complying with applicable data protection laws
9. Intellectual Property
9.1 OpiScope IP
OpiScope and its products are owned by ThePrimeContact. These Terms do not grant you any right to our intellectual property.
9.2 Your Content
You retain ownership of content you create using OpiScope (surveys, questions, results). By posting content, you grant us a limited license to:
- Store and display the content as needed to provide the service
- Use anonymized, aggregated data for platform improvement
9.3 Feedback
If you provide feedback or suggestions, we may use them without obligation to you.
10. Service Availability & Support
10.1 Availability
We strive for high availability but do not guarantee 100% uptime. Scheduled maintenance will be announced in advance.

11. Termination
11.1 By You
You may terminate your account at any time:
- In-platform: Account Settings → Close Account

- Your account is deactivated
- You can export your data for 30 days
- After 30 days, data is permanently deleted (subject to legal retention)
11.2 By Us
We may suspend or terminate your account for:
- Violation of these Terms
- Non-payment of fees
- Extended inactivity
- Legal requirement
- Discontinuation of the platform
11.3 Survival
Sections that by their nature should survive termination (data rights, IP, liability limitations) will survive.
12. Liability & Disclaimers
12.1 Disclaimer
OpiScope is provided "as is" without warranties of any kind, express or implied. We do not warrant:
- Uninterrupted or error-free operation
- That the platform will meet your specific requirements
- Accuracy of any information provided through the platform
12.2 Limitation of Liability
To the maximum extent permitted by law:
- We are not liable for indirect, incidental, or consequential damages
- Our total liability is limited to the fees you paid in the 12 months preceding the claim
- These limitations do not apply to gross negligence, willful misconduct, or liability that cannot be limited by law
12.3 Indemnification
You agree to indemnify us against claims arising from:
- Your violation of these Terms
- Your violation of applicable laws
- Content you create or data you collect using OpiScope
13. Changes to These Terms
13.1 Material Changes
We will notify you of material changes at least 30 days before they take effect via:
- Email to your registered address
- In-platform notification
13.2 Acceptance of Changes
- Continued use after changes take effect constitutes acceptance
- If you disagree, you must stop using OpiScope and close your account
- We will remind you of your right to terminate before changes take effect
14. Flagging and Reporting
14.1 Right to Flag
Any person may flag a survey for violation of our Terms of Service, Privacy Policy, or applicable Tunisian law. Flags can be submitted through the "Flag" button on every survey page.
14.2 How We Handle Flags
1. We review every flag based on severity
2. We notify the publisher and give them an opportunity to respond
3. For serious violations (INPDP, child protection, harassment), we may pause the survey immediately
4. We may revoke a Verified badge if a flag is validated
14.3 Good Faith
Flags must be made in good faith. False or malicious flags may result in account termination.
14.4 Anonymous Flagging
You may submit flags anonymously. However, providing contact information helps us follow up if we need more information.
14.5 Reporting to INPDP
OpiScope reserves the right to report confirmed violations to the INPDP or other relevant authorities.
15. Governing Law & Disputes
15.1 Governing Law
These Terms are governed by Tunisian law, without regard to conflict of law principles.
15.2 Dispute Resolution
Informal resolution: Contact us first at [legal@opiscope.com]. We will attempt to resolve disputes informally. Mediation: If informal resolution fails, parties may agree to mediation. Jurisdiction: Any disputes not resolved through mediation shall be submitted to the courts of Tunis, Tunisia.15.3 Applicable Regulations
These Terms are subject to:
- Organic Law No. 2004-63 (data protection)
- Law No. 2000-83 (electronic commerce)
- Decree-Law No. 2022-54 (cybercrime)
- Other applicable Tunisian laws
16. General Provisions
16.1 Entire Agreement
These Terms, together with the Privacy Policy and Product Terms, constitute the entire agreement.
16.2 Severability
If any provision is found unenforceable, the remaining provisions continue in effect.
16.3 Waiver
Failure to enforce a provision does not constitute a waiver.
16.4 Assignment
You may not assign these Terms without our consent. We may assign them in connection with a merger or acquisition.
16.5 Notices
Notices to you: email to your registered address, or in-platform notification.

17. Language
These Terms are drafted in English. In case of conflict between translations, the [English/French/Arabic] version prevails.

19. Territorial Application
These Terms apply to users of the OpiScope platform. Under Organic Law 2004-63:
- If you are a Controller established in Tunisia, Tunisian law applies to all your processing
- If you are a Controller established outside Tunisia but targeting Tunisian respondents, Tunisian law may still apply to your processing of Tunisian data subjects
- OpiScope processes data on your behalf as a processor; you remain the controller for your respondents' data
