Welcome to OpiScopeDirectory, a product of the OpiScope platform. These Product Terms of Service ("Product Terms") govern your use of OpiScopeDirectory, the public survey discovery and results listing product.
By activating or using OpiScopeDirectory, you agree to these Product Terms in addition to the OpiScope Platform Terms of Service. In case of conflict, these Product Terms govern for OpiScopeDirectory.
2. Definitions
These terms are used throughout these Product Terms and all OpiScope legal documents:

| Controller (or "Data Controller") | The legal entity that determines the purposes and means of processing personal data, as defined in Art. 2 of Organic Law 2004-63. In our product interface, this is called "Organization." In our marketing materials, this is called "Publisher." |
| Organization | The product-interface term for the entity that owns surveys and acts as data controller. |
| Publisher | The marketing/commercial term for the Organization. |
| Org Owner | The natural person authorized to bind the Organization and accept legal documents on its behalf. |
| Team Member | An employee or agent of the Organization acting under its authority. |
| Survey Creator | A Team Member or the Org Owner with permission to create surveys on behalf of the Controller. |
| Processor | An entity that processes personal data on behalf of the Controller. OpiScope acts as Processor for product data. |
| Respondent | A natural person who participates in a survey by providing responses. |
| Personal Data | Any information relating to an identified or identifiable natural person (Art. 2, Organic Law 2004-63). |
| Sensitive Data | Data relating to health, religion, politics, race, union affiliation, genetic or biometric data (Arts. 47-49, Organic Law 2004-63). |
| Anonymized Data | Data that cannot identify any natural person by any means reasonably likely to be used. Anonymized data is NOT personal data and falls outside the scope of Organic Law 2004-63. |
| INPDP | Instance Nationale de Protection des Données Personnelles — Tunisia's national data protection authority. |
| Flag | A report submitted by any person alleging that a survey violates OpiScope's Terms, Privacy Policy, or applicable law. |
| Verified Badge | A badge OpiScope assigns to a Publisher who has uploaded valid INPDP documentation and had it verified by OpiScope. |
3. About OpiScopeDirectory
OpiScopeDirectory is a public survey directory that allows:
- Survey creators to optionally list their surveys for public discovery
- Visitors to browse, search, and participate in listed surveys
- Aggregated results to be displayed for surveys that opt in to publication
4. Visibility & Listing
4.1 Opt-In Listing
Surveys are PRIVATE by default. A survey is listed in OpiScopeDirectory only if the Controller explicitly opts in by changing visibility to DIRECTORY.

4.2 Listing Content
When you list a survey in OpiScopeDirectory, the following information is visible to the public:
- Survey title
- Survey description/summary
- Category
- Provider/organization name
- Estimated time
- Number of questions
- Status (Open/Closed)
- Response count (approximate)
- Language(s)
- NOT visible: Individual responses, email addresses, IP addresses, any personal data
4.3 Listing Rules
You must NOT list surveys that:
- Collect Sensitive Data without proper consent and INPDP authorization
- Misrepresent the survey's purpose or sponsorship
- Are disguised sales, fundraising, or political campaigning
- Violate any applicable law or regulation
5. Aggregated Results Publication
5.1 How Results Are Published
If you choose to publish results on OpiScopeDirectory:
- Only aggregated results are displayed — never individual responses
- Results are displayed only after reaching the minimum response threshold ([specify — e.g., 30 responses])
- Cross-tabulations require higher thresholds to prevent re-identification
5.2 Publication Standards
Published results should include:
- Sponsor of the research
- Dates of data collection
- Population under study
- Sample size and selection method
- Margin of sampling error (if applicable)
- Question wording and response options
- Mode of data collection
- Weighting procedures (if any)
5.3 Your Responsibilities
As the Controller:
- You decide whether to publish results
- You are responsible for the accuracy of published results
- You must ensure aggregation prevents individual identification
- You can unpublish results at any time
6. Roles & Responsibilities
6.1 Organizations (Publishers/Survey Creators)
You are the data controller for:- Your survey content
- Respondent data
- Published results
- Ensure listing is appropriate and accurate
- Comply with data protection laws
- Provide privacy notice to respondents
- Handle respondent requests
- Ensure aggregated results do not re-identify individuals
6.2 Org Owners
The Org Owner acts as the legal representative of the Organization and:
- Files prior declarations with INPDP on behalf of the Organization
- Obtains INPDP authorizations on behalf of the Organization
- Ensures Team Members comply with data protection obligations
6.3 Directory Visitors
Visitors to OpiScopeDirectory agree to:
- Not attempt to re-identify anonymous respondents
- Not scrape or harvest data from the directory
- Not misuse any information found in the directory
- Comply with the Platform Terms of Service
6.4 OpiScope
We are:- The data processor for respondent data
- The data controller for directory analytics (visitor behavior, search queries — anonymized)
- The platform operator that displays aggregated, public information
7. INPDP Compliance for Publishers
7.1 Prior Declaration
Before listing a survey in OpiScopeDirectory that collects personal data, you must file a prior declaration with the INPDP (Art. 7).
7.2 Sensitive Data Authorization
If your listed survey collects Sensitive Data, you must obtain INPDP authorization (Arts. 47-49).
7.3 Cross-Border Transfer Authorization
If you transfer respondent data outside Tunisia, you must obtain INPDP authorization (Art. 52).
7.4 Your Warranty
By listing a survey, you warrant that:
- You have filed all required declarations with INPDP
- You have obtained all required authorizations
- You will provide proof of such declarations upon request
8. Verified Badge
8.1 What It Is

| Verified | Publisher has uploaded valid INPDP prior declaration (and authorizations where applicable) and OpiScope has verified the document's validity. |
| Unverified | Publisher has not uploaded INPDP documentation or verification is pending. |
8.2 Unverified Publishers
Unverified publishers can still list surveys in OpiScopeDirectory. However:- Unverified publishers see a warning on their dashboard
- Respondents see an "Unverified" badge on the survey
- Visitors are warned that the Publisher has not verified INPDP compliance
9. Prohibited Uses
You must NOT use OpiScopeDirectory to:
- List surveys that collect Sensitive Data without proper consent and INPDP authorization
- Misrepresent the purpose or sponsorship of a survey
- Re-identify anonymous respondents
- Scrape or harvest data from the directory
- Publish results that could identify individual respondents
- Use directory data for targeted advertising or spam
- Impersonate other organizations or surveys
- List surveys that violate applicable law
10. Flagging and Reporting
10.1 Right to Flag
Any person may flag a survey listing for violation of:
- These Product Terms
- The Platform Privacy Policy or applicable Product Privacy Notice
- Applicable Tunisian law (including INPDP rules)
10.2 Flag Categories

10.3 How Flags Are Handled
1. Automated triage — flags are categorized by severity
2. Publisher notification — you are notified and given an opportunity to respond
3. Response period — you have [7/14] days to respond
4. Escalation — if you don't respond or the flag is validated, OpiScope may remove the listing, revoke your Verified Badge, or suspend your account
10.4 Account Status After Flagging

11. Survey Removal & Moderation
11.1 Removal by Creator
You may remove your survey from OpiScopeDirectory at any time by changing visibility to PRIVATE.
11.2 Removal by OpiScope
We may remove a survey listing if it:
- Violates these Product Terms
- Violates applicable law
- Collects Sensitive Data without proper authorization
- Misrepresents its purpose or sponsorship
- Is flagged by users and found to be in violation
11.3 Notice
We will notify the survey creator before removal unless:
- Immediate removal is necessary to prevent harm
- Required by law
- The creator is unresponsive
12. Intellectual Property
12.1 Your Content
You retain ownership of your survey content and published results.
12.2 License to OpiScope
By listing a survey in OpiScopeDirectory, you grant OpiScope a license to:
- Display the listing information (title, description, metadata)
- Display aggregated results
- Index the listing for search functionality
- Syndicate listing information (e.g., search engines, social media previews)
12.3 Respondent Data
Respondent data belongs to the respondents. You have a license to use it for the purposes disclosed in your privacy notice.
13. Liability & Disclaimer
13.1 Directory Content
OpiScopeDirectory displays information provided by survey creators. We do not:
- Verify the accuracy of survey descriptions
- Verify the quality or ethics of listed surveys
- Endorse any listed survey or its creator
13.2 Visitor Risk
Visitors participate in surveys at their own risk. We are not responsible for:
- The content of listed surveys
- The data practices of survey creators
- The accuracy of published results
13.3 Indemnification
You agree to indemnify OpiScope against claims arising from:
- Your violation of these Product Terms
- Your violation of applicable laws
- Your survey content or published results
14. Termination
14.1 By You
You may stop using OpiScopeDirectory at any time by setting your surveys to PRIVATE visibility.
14.2 By Us
We may terminate your access to OpiScopeDirectory if:
- You violate these Product Terms
- You violate applicable law
- You list surveys that collect Sensitive Data without proper authorization
14.3 Effect of Termination
Upon termination:
- Your surveys are removed from the directory
- Your Platform account remains active (unless separately terminated)
15. Changes to These Product Terms
We may update these Product Terms from time to time. Material changes will be notified at least 30 days in advance via email and in-platform notification. Continued use after changes constitutes acceptance.
16. Governing Law
These Product Terms are governed by Tunisian law, including:
- Organic Law No. 2004-63 (data protection)
- Law No. 2000-83 (electronic commerce)
- Other applicable Tunisian regulations

18. Relationship to Platform Terms
These Product Terms supplement the OpiScope Platform Terms of Service. Together, they form the complete agreement for your use of OpiScopeDirectory.
This document is a draft. It must be reviewed by qualified Tunisian legal counsel before publication. It does not constitute legal advice.
